Refund Policy

1. Project Milestones

AureliaVertexWorks structures all projects around clearly defined milestones. Each milestone represents a distinct deliverable phase in the development pipeline. Refund eligibility is assessed based on the completion status of project milestones at the time of cancellation request.

2. Pre-Development Cancellation

If you cancel a project before any development work has commenced, you are entitled to a full refund of any advance payments made, minus any administrative processing fees (maximum 5% of the total payment). Refunds will be processed within 14 business days of the cancellation request.

3. Mid-Project Cancellation

If cancellation occurs after development has begun but before project completion:

  • You are entitled to a prorated refund based on the percentage of milestones not yet completed and paid for.
  • All completed milestone payments are non-refundable, as work has been delivered for those phases.
  • Any work-in-progress at the time of cancellation will be delivered in its current state.

4. Post-Delivery Disputes

If you identify material defects or significant deviations from the agreed project specifications after delivery, you must notify AureliaVertexWorks within 14 days of delivery. We will evaluate the claim and, if valid, either rectify the defects at no additional cost or issue a partial refund proportional to the impact of the identified issues.

5. Non-Refundable Items

The following are non-refundable:

  • Custom 3D model assets that have been delivered and accepted.
  • Third-party license fees incurred on your behalf (e.g., hosting, domain registrations, premium plugins).
  • Consultation and strategy sessions that have been delivered.
  • Work completed under change orders approved in writing.

6. Refund Process

To request a refund, contact [email protected] with your project reference number and a description of the reason for the refund request. All refund requests will be reviewed within 5 business days. Approved refunds will be processed via the original payment method within 14 business days.

Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by AureliaVertexWorks, located at Calle de Bravo Murillo 120, Madrid, Tetuán, España, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use our services. These terms constitute a legally binding agreement between you (the "Client") and AureliaVertexWorks (the "Provider").

2. Scope of Services

AureliaVertexWorks provides web development, WebGL 3D visualization, interactive experience design, and related digital services. The specific scope, deliverables, timeline, and pricing for each project will be defined in a separate written agreement or proposal accepted by both parties. The Provider reserves the right to refuse or terminate services at its discretion.

3. Payment Terms

All payments are due according to the milestone schedule defined in the project agreement. Invoices are payable within 14 days of issuance unless otherwise specified. Late payments may incur a surcharge of 1.5% per month on the outstanding balance. The Provider reserves the right to suspend work on any project where payments are more than 7 days overdue.

4. Intellectual Property

Upon full payment of all project fees, the Client receives full ownership of all custom-developed deliverables, including source code, 3D models, design assets, and documentation created specifically for the project. The Provider retains the right to use anonymized project descriptions and visual materials for portfolio and marketing purposes unless explicitly restricted in writing. Third-party libraries, frameworks, and tools remain subject to their original licensing terms.

5. Project Modifications

Changes to the agreed project scope, deliverables, or timeline must be submitted in writing and will be evaluated by the Provider. Significant scope changes may result in revised pricing and timeline estimates. The Provider will communicate any impact promptly and no work on modified scope will commence until mutual written agreement is reached.

6. Warranties and Limitations

AureliaVertexWorks warrants that all services will be performed with reasonable skill and care consistent with industry standards. The Provider does not guarantee specific business outcomes, conversion rates, or revenue results from delivered projects. All deliverables are provided "as is" after the acceptance period, with any defects reported within the timeframe specified in the Refund Policy.

7. Limitation of Liability

To the maximum extent permitted by applicable law, AureliaVertexWorks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use our services. The Provider's total liability for any claim shall not exceed the total amount paid by the Client for the specific project giving rise to the claim.

8. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the business relationship. This includes project specifications, business strategies, technical architectures, and any other information designated as confidential. This obligation survives the termination of the business relationship for a period of 24 months.

9. Termination

Either party may terminate this agreement with 14 days' written notice. The Client remains liable for all work completed and expenses incurred up to the date of termination. The Provider will deliver all completed work-in-progress upon receipt of payment for completed milestones.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, España.
